LIBER’s Response – Call for Evidence for Better Copyright Environment for European Creativity & Innovation
LIBER Europe Contribution to the Call for Evidence on the expected targeted initiative for a better copyright environment for European creativity and innovation.
On 13 May 2026, the European Commission published a Call for Evidence on the expected targeted initiative for a better copyright environment for European creativity and innovation. The aim of the call is to adjust the EU copyright framework to improve the competitiveness of the EU creative sectors and facilitate innovation. Specifically, the call is focusing on the review of the 2019 Copyright in the Digital Single Market Directive (DSMD) .
In the response, LIBER recommends the review to focus on the following priorities:
- a binding, harmonised EU-wide Secondary publication right for authors;
- a mandatory, broadly formulated research exception that applies uniformly across
Member States and works across borders; - effective safeguards for research uses and text and data mining in the context of
AI; - protection of research-related exceptions against contractual and technological
circumvention; - a modern, technology-neutral definition of research;
- a simplified and workable framework for out-of-commerce works;
- close coordination between the copyright review and the upcoming ERA Act.
